Terms and Conditions

These terms and conditions govern the sale and purchase of goods at auctions conducted by Whyte Auctioneers (“the Auctioneer”), Unit 22 Moderna Business Park, Moderna Way, Mytholmroyd, West Yorkshire, HX7 5QQ.
Buyer Conditions
- All lots are sold as seen. Descriptions are given in good faith but do not constitute warranties.
- A buyer’s premium of 20% is added to the hammer price.
- Payment must be made on the day of sale or within 3 working days for online bidders.
- Accepted payment methods: cash, debit card, bank transfer. Credit cards are not accepted.
- Lots must be collected within 7 working days. Storage charges of £2 per lot per day apply thereafter.
- Title to goods does not pass until full payment has been received.
Seller Conditions
- Seller’s commission is charged at 15% of the hammer price plus a £1 lotting fee per item.
- Payment to sellers is made within 21 working days of the auction by bank transfer.
- The Auctioneer reserves the right to refuse any item deemed unsuitable for auction.
- Reserve prices may be set by agreement. Items without reserves will be sold to the highest bidder.
- Unsold items must be collected within 14 days. The Auctioneer may dispose of uncollected items after this period.
Online Bidding
- Online bidding is provided through EasyLiveAuction and is subject to their terms of service.
- The Auctioneer is not responsible for technical issues affecting online bidding.
- Online buyers are subject to the same terms as saleroom buyers.
Liability
The Auctioneer acts as agent for the seller. All lots are sold as described in the catalogue. The Auctioneer is not liable for errors in cataloguing beyond making reasonable efforts to describe items accurately.
Disputes
Any disputes shall be governed by English law. The Auctioneer’s decision on all matters relating to the conduct of the auction is final.
